ITC Section 337 institution (Inv. 337-TA-1523): certain DDR5 DRAM devices — Netlist patent complaint against Micron, HPE, Lenovo, Supermicro (procedural)
The USITC has instituted Section 337 investigation 337-TA-1523 on certain DRAM devices (specifically, DDR5-generation DIMMs) and products containing the same (such as servers, computing systems and storage systems) and components thereof (91 FR 60980; the Commission ordered institution on September 22, 2026): Netlist, Inc. of Irvine, California filed a complaint on August 11, 2026 (supplemented August 25, 2026) alleging infringement of U.S. Patent Nos. 10,025,731, 10,217,523, 12,373,366 and 12,675,407, and requesting a limited exclusion order and cease-and-desist orders; respondents include Micron Technology, Micron Semiconductor Products, Hewlett Packard Enterprise, Lenovo Group, Lenovo (United States) and Super Micro Computer. This is an IP-based import-relief proceeding; institution itself changes no tariff rates. Any later limited exclusion order affecting imports of the involved products would be tracked then.
