ITC Section 337 (flash-spun nonwoven materials/TYVEK case, Inv. 337-TA-1424): review-in-part of violation FID; submissions on remedy (procedural)
The USITC has determined to review in part the final initial determination of the presiding administrative law judge finding a Section 337 violation in Inv. 337-TA-1424 and requests written submissions on remedy, the public interest and bonding (91 FR 60647). The case was brought by DuPont entities alleging trade-secret misappropriation and infringement of the TYVEK word marks and blue octagon mark, with respondents including Chinese companies such as Xiamen Dangs, Kingwills and Qingyun. This is an IP-based import-relief proceeding with no tariff-rate effect at this stage; any later remedy order affecting imports of the involved products would be tracked then.
