Section 232 polysilicon anti-stockpiling temporary final rule: weekly volume caps for new importers and entry bans for stockpilers through Dec 4, 2026 (91 FR 60505)
The Bureau of Industry and Security (BIS) issued a temporary final rule (supplement no. 1 to 15 CFR part 705; 91 FR 60505, published September 24, 2026) to prevent stockpiling ahead of the December 4, 2026 polysilicon import adjustments (minimum import prices plus tariffs) under Proclamation 11052 (August 6, 2026; 91 FR 51975): (1) existing importers of record found to be importing volumes substantially above their historic averages will be barred by CBP notice from further entries of Polysilicon Products before December 4; (2) new IORs registered with CBP on or after August 6, 2026 may not, absent Commerce approval, exceed weekly volumes of — 12 kg for polysilicon (HTSUS 2804.61.00), 7 kg for doped polysilicon products (3818.00.0020/.0040/.0045/.0050/.0091), 2,000 units for photosensitive semiconductor devices (8541.42.00) and 55 units for other 8541.43.00 goods — after which further entries are prohibited; (3) restricted companies may apply to Commerce for a waiver (Polysilicon232@bis.doc.gov); (4) BIS and CBP will act against multiple-IOR and broker-facilitated circumvention. Effective September 22 through December 3, 2026. This is a quantitative/eligibility import restriction that adds no tariff rates; the December 4 MIP and tariffs follow the proclamation itself.
